These Terms of Service (“Terms”) govern your use of the EMUAIDMAX online store and any purchase made through it. In these Terms, “EMUAIDMAX,” “we,” “us,” and “our” refer to the operator of this online store. Shopify provides the ecommerce platform that enables us to offer products and services to you.

1. Acceptance of these Terms

By accessing the store or placing an order, you agree to these Terms and the policies incorporated by reference, including our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, do not use the store.

2. Eligibility and lawful use

You must be legally capable of entering into a binding agreement in your jurisdiction. You may not use the store or its content for unlawful, fraudulent, abusive, or unauthorized purposes, or interfere with the security or operation of the store.

3. Product and health information

Product information is provided for general informational purposes and is not medical advice or a substitute for diagnosis or treatment by a qualified healthcare professional. Read and follow the complete physical product label, including all ingredients, directions, and warnings. Product packaging and the current label control if online information differs.

Products must be used only as directed. Seek qualified medical advice for severe, persistent, recurring, or worsening symptoms, serious burns or wounds, suspected allergic reactions, or any urgent concern. Homeopathic products offered through the store have not been evaluated by the U.S. Food and Drug Administration for safety or efficacy.

4. Product availability and presentation

We make reasonable efforts to describe products accurately and display representative images. Screen settings and packaging updates can affect appearance. We may limit quantities, discontinue products, or correct inaccurate information without prior notice, subject to applicable law.

5. Orders

An order is an offer to purchase. We may accept, decline, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, payment authorization failure, shipping restrictions, or suspected resale. If we cancel an order after payment, the amount charged for the canceled portion will be refunded.

6. Pricing, discounts, taxes, and payment

Prices are shown in U.S. dollars unless stated otherwise. Discounts are subject to their displayed conditions and may not be combined unless expressly allowed. Applicable taxes and shipping charges are calculated or disclosed at checkout. You represent that the payment and billing information supplied is accurate and that you are authorized to use the payment method.

7. Shipping, returns, and refunds

Order processing, shipping rates, delivery estimates, address responsibilities, returns, and refunds are governed by our Shipping Policy and Refund Policy. Delivery dates are estimates unless expressly stated otherwise.

8. Intellectual property

Store content, including text, photography, graphics, branding, layout, and software, is owned by or licensed to the relevant rights holder and is protected by applicable intellectual property laws. You may use the store only for personal, non-commercial shopping purposes. No content may be copied, reproduced, distributed, sold, or exploited without authorization.

The store may use or link to services operated by Shopify, payment providers, carriers, and other third parties. Their separate terms and privacy practices may apply. We are not responsible for third-party websites that we do not control.

10. Reviews and submissions

If you submit feedback, reviews, photographs, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not infringe another person’s rights. We may remove content that violates these Terms or applicable law. We will not present fabricated reviews or materially alter a customer’s meaning.

11. Disclaimer of warranties

To the fullest extent permitted by law, the store and its content are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access or that every error will be corrected. Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the store or products. Our aggregate liability for a claim relating to an order will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where liability cannot be limited under applicable law.

13. Indemnification

To the extent permitted by law, you agree to indemnify us against third-party claims resulting from your unlawful misuse of the store, violation of these Terms, or infringement of another person’s rights.

14. Severability and waiver

If any provision is held unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver of the right to enforce it later.

15. Governing law

These Terms are governed by the laws applicable in the State of Tennessee and the United States, without limiting mandatory consumer protections that apply where you live.

16. Changes

We may update these Terms by publishing a revised version on this page. Changes apply from the stated update date and do not retroactively reduce rights relating to an order already accepted, except where required by law.
